I acknowledge that basketball can be strenuous and vigorous and may carry with it the potential for serious injury/illness and death. I agree that by participating in basketball and strength/conditioning training, in person and/or online, I do so entirely at my own risk. I agree that I am voluntarily participating in these activities and voluntarily using any and all facilities and premises and assume all risks. I also understand that my trainer (LaCondra Mason) and the operations of any and all facilities and premises are not responsible for the loss of my personal property.

 

I agree that I have obtained a physical examination from a qualified medical professional and I am physically fit to participate in basketball and training. I agree that there are no health-related conditions, problems, or limitations which prevent my participation. I attest that I have medical insurance and I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during my participation.

 

I understand that during training, I may be photographed and in videos. I agree to allow my photos and videos to be used for marketing and promotional purposes by my trainer. I understand that my photos and videos can be posted on social media, websites, and other marketing tools. I understand that it is my responsibility to notify my trainer if I am not comfortable with sharing videos and/or photographs of me. 

 

I acknowledge and fully understand that this “waiver and release” is a release of liability. I expressly agree to release and discharge my trainer, her next of kin, heirs, and associates; any and all facilities used, equipment, their directors, officers, employees, volunteers, representatives, and agents, from any and all claims or causes of actions. I agree to voluntarily give up or waive any right that I may otherwise have to bring legal action against my trainer and facilities used for personal injury or property damage.

 

I acknowledge that this is also a release of negligence, active or passive, by my trainer or facilities used during my training.

 

The waiver and release of liability shall be understood broadly to provide a release and waiver to the maximum extent permissible under applicable law. I understand that if any part of this agreement is deemed void, this will have no effect on the remainder of this release of liability.

 

I certify that I have read this document and fully understand its content. I am aware that this is a release of liability and a contract that I sign on my own free will. I acknowledge and understand that the content of this release cannot be modified orally.

Parent/Guardian Waiver For Minors

 

The parent and natural guardian does hereby represent that he/she is in fact acting in such capacity, has consented to his/her child's participation in the training, and has agreed individually and on behalf of the child, to the terms of the waiver and release of liability set forth above. The parent or guardian further agrees to save and hold harmless and indemnify each and all parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties.
